John Beggs QC and Sarah Simcock successful in police pensions judicial review for Derbyshire Police

John Beggs QC and Sarah Simcock successfully resisted a judicial review claim on behalf of the Chief Constable of Derbyshire Constabulary by a former police officer.

 

Former DS Sidwell claimed permanent disablement from working for Derbyshire Constabulary as a result of an anxiety disorder which he said was suffered as a result of bad treatment of him by the Force. The Force had previously certified he was not so disabled with which decision the Police Medical Appeals Board agreed. The judicial review proceedings concerned whether the PMAB had applied the law correctly as to whether DS Sidwell was permanently disabled within the meaning of the Police Pensions Regulations 1987. Mostyn J found that it had done so and dismissed former DS Sidwell’s claim, also refusing him permission to appeal.
