Elliot Gold successful in judicial review on the meaning of police misconduct grounds of appeal

Elliot represented the Chief Constable of West Yorkshire as an interested party, supporting the decision of the Police Appeals Tribunal. The High Court upheld the decision of the Police Appeals Tribunal to dismiss an ex-officer’s appeal for having no prospect of success and accepted Elliot’s submissions on the ambit of and distinction between the statutory grounds of appeal concerning fresh evidence and breach of procedures.
This is an important decision for any officer seeking to appeal a police misconduct hearing, who should frame their notice and grounds of appeal carefully to fit the specific requirements of the statutory grounds.
