John Beggs QC and James Berry appear in first successful challenge to Police and Crime Commissioner

John Beggs QC and James Berry represented Lincolnshire Police’s Temporary Chief Constable, Neil Rhodes, in his successful judicial review of the PCC for Lincolnshire, who suspended the T/CC when a potential conduct issue came to light. On 28 March 2013 Stuart-Smith J quashed the suspension, declaring it to be irrational. Mr Rhodes has since returned to work and from 1 April 2013 is Acting Chief Constable.
This is understood to be the first case in which a suspension in the police misconduct field has been successfully challenged by way of judicial review. It is the second case involving a PCC, the first being Port v Mountstevens, in which John and James appeared for the successful PCC.
