Amy Street appears in the Supreme Court – Cheshire West
21st October 2013
Amy Street appears in the Supreme Court from 21 to 23 October 2013 in the case of Cheshire West. In this landmark human rights case, which began in the Court of Protection, seven justices of the Supreme Court will rule on whether people lacking capacity to decide about their care and residence, and who are not free to leave their social care placements, are deprived of their liberty under Article 5 of the European Convention on Human Rights. Only if they fall under Article 5 do they have important procedural safeguards.
Amy is instructed by O’Donnells Solicitors on behalf of the Official Solicitor as litigation friend to one of the appellants arguing for human rights protection.
