Liam Duffy secures dismissal of claim brought against Guy’s and St Thomas’ NHS Foundation Trust

The claim concerned an allegedly excessive administration of the antibiotic gentamicin on an intensive care unit to a patient in end stage renal failure. The patient survived his admission but sadly went on to suffer the recognised complication of ototoxicity. The Court held that the dose was reasonable and logical in view of the seriousness of the patient’s condition, notwithstanding that national guidelines suggested a lower dose should be given to patients with renal failure. The judgment (please see here) contains a useful summary of the case law relating to the application of national and local guidelines in clinical negligence cases.
