12th Serjeants’ Inn / Oxford Neurosurgery Medical Law Conference

We are delighted to confirm that the 12th Oxford Medical Law Conference will be held on Wednesday 18th September 2024 at Corpus Christi College, Oxford.
John de Bono KC and Consultant Neurosurgeon, Richard Stacey, have been organising this very popular annual event for claimant and defendant clinical negligence lawyers since 2010.
The focus of the 2024 conference will be Causation, Cauda Equina Syndrome and Stroke. We have another stellar line up, with the return of neurosurgeons Robert Macfarlane, Nick Todd and Peter Kirkpatrick together with Richard Stacey. They will be joined by urology experts including John Reynard. We will look at how to ‘win’ or ‘defend’ CES cases with discussion of real life scenarios, with and input from Serjeants’ Inn barristers including Christopher Johnston KC.
Issues to be considered include:
(i) whether the CESI/ CESR model is outdated and how it fits with material contribution causation;
(ii) who has the burden of proof in arguing that the outcome would have been the same in any event; and
(iii) in light of FCA v Arch and Holmes v Poeton, can a claimant win even if the outcome would probably have been the same in any event?
Practitioners know just how complex causation can be in the context of stroke and we are delighted to be joined by well-known stroke physician, Dr Neil Baldwin, to discuss windows of opportunity for stroke prevention and the effect of aspirin, thrombolysis and thrombectomy. Again it is planned that the stroke sessions will be interactive and use worked examples.
This conference is an opportunity for clinical negligence enthusiasts with both claimant and defendant practices to discuss some of the most difficult issues in clinical negligence practice. For those interested in CES, spinal injury, stroke or causation generally it is not to be missed.
