Bridget Dolan QC, Sophia Roper and Caroline Hurst of Switalskis Solicitors will discuss the practical issues around bringing and defending HRA claims in the context of the recent CoP case of CH v A Metropolitan Council [2017] EWCOP 12.

Serjeants’ Inn has joined forces with Oxford neurosurgeon Richard Stacey to organise this event for both claimant and defendant clinical negligence enthusiasts. We aim for an interesting mix of medical and legal talks and will be offering a ‘speed dating’ session after lunch with a more informal opportunity to ask questions of our medical speakers.

The challenge to the best interests jurisdiction and the role of doctors and judges in this tragic case has received saturation media reporting. It’s been fuelled by unprecedented social media coverage and an astonishingly successful crowd funding campaign.
It’s put medical ethics and treatment decisions on the front page and looks set to be one of the biggest medical law cases of 2017.
Serjeants’ Inn silks and juniors have been instructed from the directions hearing in March all the way through to the Supreme Court in June. They’ll be talking about why the challenge to jurisdiction matters, interim orders and whether the unprecedented transparency has damaged or promoted greater public understanding of medical ethics.

This is a practically focused seminar for solicitors typically representing institutions at inquests. It will provide an essential update on important cases for coronial law over the past year and consider how the CJA and recently decided cases impact upon practice in the Coroner’s Court.
