James Berry successfully defends judicial review challenge to party conference accreditation system

In R (Segalov) v Chief Constable of Sussex Police & Chief Constable of Greater Manchester Police, the Claimant, a Labour Party member and journalist challenged the decision to refuse him police accreditation to attend the 2017 Labour Party conference and also the police system for party conference accreditation itself.
James represented Greater Manchester Police, who host the National Accreditation Team (NAT) that deals with police accreditation for party conferences and other major events. James successfully argued that common law procedural fairness and Article 8 ECHR did not require NAT to have a published policy, or to give applicants an opportunity to make submissions before NAT refers their application to the police force hosting the event in question for an accreditation decision, and that the test applied by NAT to determine whether to refer an application to the host force was lawful.
The Claimant’s challenge to the process adopted by Sussex Police in determining his accreditation application succeeded.
