John Beggs QC and Alexander dos Santos succeed in an appeal by case stated before the Divisional Court

John Beggs QC and Alexander dos Santos, instructed by Royal Mail Group Limited, succeed in an appeal by case stated before the Divisional Court. The appeal concerned a decision by a District Judge at Ipswich Magistrates’ Court in which the law concerning the Dangerous Dogs Act 1991 was misapplied. The judgment is an important one for all prosecutions of owners of dogs which are dangerously out of control and highlights the strict liability nature of offences under section 3 of the Act.
Previously, Alexander dos Santos had obtained a voluntary bill of indictment from the Administrative Court on the same issue in an unrelated matter where a Circuit Judge had fallen into the same error.
