New Guidance for Chief Constables on civil protection orders
21st October 2022
Rachel Spearing advised and appeared for the successful Chief Constable in a case that addresses the challenges for police following the release of high-profile offenders on life licence, where risks of sexual harm exist to the public, and licence conditions were believed to preclude civil order applications.
This important case for the police, and those concerned with public protection and civil order applications, is a helpful digest of case law discussion upon the use of SHPOs. Guidance on anonymity for notorious offenders can also be found in the judgment.
