Criminal or civil: What is the right standard for disciplinary proceedings?
8th November 2018
A panel discussion chaired by His Honour Brian Barker CBE QC
In the light of the consultation by the Solicitors Disciplinary Tribunal and the recent change to the civil standard of proof made by the BSB, the panel will consider whether the criminal standard of proof is fit for purpose in disciplinary proceedings. What are the practical effects of the different standard of proof on the likely success of proceedings and the frequency with which they are brought, and does this vary between fields? Does one size fit all?
